Terms of Service

These Terms of Service (“Terms”) form a legally binding agreement between you and Madyra (“Madyra”, “we”, “us”, or “our”) governing your access to and use of the Madyra mobile application and the website at madyra.com (together, the “Services”). By downloading, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. About Madyra
Madyra provides a restaurant-discovery experience: partner restaurant listings, map views, menus or related materials where available, and public promotional banners or coupons. Madyra is based in Jeddah, Kingdom of Saudi Arabia. Contact: medyraceo@gmail.com Website: https://www.madyra.com
2. Eligibility
You must be able to form a binding contract under the laws of your place of residence to use the Services. If you use the Services on behalf of a business, you represent that you have authority to bind that business to these Terms.
3. No customer account required
The customer-facing app does not require you to create a Madyra server account or log in to our servers. Continuing in the app may start a local guest experience on your device only. Optional display name or photo settings, if offered, are stored on your device and are not a server-side user account.
4. License to use the Services
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the app on devices you own or control, and to access the website, solely for your personal, non-commercial use of the Services as provided by Madyra. You may not: (a) copy, modify, or create derivative works of the Services except as allowed by law; (b) reverse engineer, decompile, or attempt to extract source code except where mandatory law permits; (c) rent, sell, sublicense, or commercially exploit the Services; (d) remove proprietary notices; or (e) use automated scraping or bulk extraction in a way that harms or overloads our systems.
5. Location features
Certain features (nearby sorting and showing your position on the map) require device location permission. Location is used on your device to help you find partner restaurants near you. You may deny or revoke permission in your device settings; some features will then be limited. Our Privacy Policy explains how location relates to privacy.
6. Restaurant information and accuracy
Listings, hours, menus, prices, photos, and offers are provided for general information and may change without notice. Madyra does not guarantee that any listing is complete, current, or error-free. Always confirm important details directly with the restaurant before visiting or relying on an offer.
7. Coupons and promotions
Coupons, promo codes, and offers displayed in the Services belong to the issuing brand or restaurant and are subject to that party’s rules, validity dates, and exclusions. Madyra is not the issuer of third-party coupons unless we expressly say otherwise. Redemption happens with the brand or restaurant, not as a payment processed by Madyra unless clearly stated.
8. Partner and third-party content
Partner restaurants and brands are responsible for their own products, services, food safety, pricing, and in-store conduct. Links or references to third-party sites, maps, stores, or apps are for convenience only. We do not control and are not responsible for third-party content or practices.
9. Acceptable use
You agree not to: • Use the Services for any unlawful purpose or in violation of these Terms. • Interfere with or disrupt the Services, servers, or networks. • Attempt unauthorized access to any system, account, or data. • Upload malware or harmful code. • Harass, abuse, or harm others in connection with the Services. • Misrepresent your identity or affiliation when contacting us. • Use the Services to infringe intellectual property or privacy rights.
10. Intellectual property
The Services, including software, design, trademarks, logos, and original content created by Madyra, are owned by Madyra or its licensors and are protected by applicable intellectual property laws. Partner names, logos, and brand assets remain the property of their respective owners and appear for identification and discovery purposes. Except for the limited license in Section 4, no rights are granted to you. Feedback you send us may be used by Madyra to improve the Services without obligation to you.
11. App stores
If you obtain the app from Google Play or another platform, you must also comply with that platform’s terms. The platform provider is not responsible for providing maintenance or support for the app unless required by its own rules. In the event of a conflict between these Terms and mandatory platform rules, the platform rules may prevail for distribution-related matters.
12. Privacy
Our collection and use of information is described in our Privacy Policy at https://www.madyra.com/privacy, which is incorporated into these Terms by reference.
13. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, MADYRA DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, secure, or error-free, or that restaurant or offer information will be accurate or complete. Dining, travel, and reliance on third-party offers are at your own risk.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MADYRA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS SHALL NOT EXCEED ONE HUNDRED SAUDI RIYALS (SAR 100) OR THE AMOUNT YOU PAID US (IF ANY) FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED.
15. Indemnity
You agree to defend, indemnify, and hold harmless Madyra and its officers, directors, employees, and agents from and against claims, damages, losses, and expenses (including reasonable legal fees) arising out of your misuse of the Services, your violation of these Terms, or your violation of any third-party rights.
16. Suspension and termination
You may stop using the Services at any time by uninstalling the app and ceasing to visit the website. We may suspend or discontinue the Services, or restrict access, if we reasonably believe you have violated these Terms, if required by law, or for operational or security reasons. Provisions that by nature should survive (including intellectual property, disclaimers, limitation of liability, and indemnity) will survive termination.
17. Changes to the Services and Terms
We may update the Services and these Terms from time to time. When we change these Terms, we will update the “Last updated” date. Material changes may also be highlighted on the website. Continued use after changes become effective constitutes acceptance, except where applicable law requires additional consent.
18. Governing law and disputes
These Terms are governed by the laws of the Kingdom of Saudi Arabia, without regard to conflict-of-law principles. Courts in Jeddah, Kingdom of Saudi Arabia, shall have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Services, subject to any mandatory consumer protections that apply in your place of residence.
19. General
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Madyra regarding the Services and supersede prior understandings on the same subject. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization or sale of assets. Nothing in these Terms creates a partnership, joint venture, or employment relationship.
